We will be doing our very best to provide a quality, reliable service at the best possible price for YOU! We can only achieve this with a little help from you - the customer. To assist us with providing you with the best service possible, while at the same time providing you with maximum freedom to use the service, we must insist on a few basic terms (please see below)...
Terms:
1) Duration of contract
Your service will last for the duration that you have paid for. If you order and pay for a monthly service on the 14th of March 2006, your service will expire on the 14th of April 2006 (unless additional payment is provided to renew the service prior to expiration). We reserve the right to suspend / terminate your service with us should you be found to use your service outside of our Acceptable Use policy (please refer to section 3).
2) Quality of service
We aim to provide our users with the best possible services, at the best possible prices. We strive to maintain top-level uptime. 500 Servers puts our customers first. We believe that customer support is a crucial part of any self-respecting company, and thus provide comprehensive support via MSN Messenger: admin@500servers.com. . High quality can only be achieved if users adhere to the few requirements outlined in our Terms & Conditions (particular attention to be paid to section 3)
3) Acceptable Use Policy
In an ideal world, we would love our users to have unlimited freedom. This is unfortunately not practical. We at 500 Servers must insist that users do not abuse, or in any way use our services in any of the following manners, or in such a manner which may lead to the degradation in service quality for others:
Users must not:
* Use the service(s) provided by us, to promote or propagate warez or pirated software / music, pornography, or other similar illegal activities.
* Use of our service(s) provided by us, to Spam, Hack, DoS Attacks or any similar activities.
* Use any of our free services for re-sale or profit.
* Do anything that may infringe upon the reputation of 500 Servers.
4) Abusive Remarks
Discrimination, racialism, and remarks regarding 500 Servers, 500 Servers staff, clan members, customers, and company sponsors is regarded as an offence, and can lead to suspension or termination of your account and permanent ban on all our systems, you will not have the right to claim a refund or use legal action against us.
5) Contract Renegotiation
If 500 Servers receives an unforeseen price increase in our bandwidth and/or circumstances beyond our control that alter the performance of the service we may have to renegotiate your current contract before the expiry date.
6) Indemnity
The User shall indemnify 500 Servers against any and all claims, damages, actions, liabilities, costs and expenses including reasonable lawyer's fee and expenses arising out of:
The User breaching or its non-observance of these Terms and Conditions; or Any breach or inaccuracy in any of the User's representation or warranties.
Conditions:
1) Changing our terms
500 Servers Reserve the right to change the terms and conditions without prior notice
2) Refunds
Once payment has been received for a service hosted by 500 Servers you cannot claim a refund or we cannot offer a refund under any circumstances.
3) Slot changing
Under no circumstances can the User change there server slots to above what they originally paid for unless addition payment is made for increased slots. When you receive your server it may be issued with a "Stock Configuration File". We will allow 48 hours for this file to be modified to be within your agreed contract.
4) Subscriptions and reoccurring payments
500 Servers require reoccurring payments to be made manually via Paypal (the appropriate PayPal link will be issued to you via e-mail upto 10 days before payment is required) please note that once you have recieved your Invoice for services by. 500 Servers the total ammount payable is required within 5 days of the due date on your invoice for continued service. If after 5 days no payment has been recieved all services with outstanding payments to the user will be cancelled.
5) Faults, Downtime and Errors
The User accepts that there may occasionally be problems with computers and telecommunication systems. Consequently the User accepts that there may be periods of downtime, relating to the Services and/or Web Site, in which the User cannot access these. However, 500 Servers will maintain reasonable effort to minimize these periods. The User accepts that in such cases of downtime, they will have no claim of breach of contract. When possible 500 Servers will notify the User of predicted downtime and/or scheduled downtime for upgrades, updates, etc. If appropriate 500 Servers may issue the User with extra credit for their services (such as extention of service).
6) 3rd Party Applications and Mods
500 Servers will only attempt to add a mod to your server if we feel it is safe to do so and will not cause any resource problems for other servers. Additionally we will NOT provide high tech support for the running of any mods added to your server. You are responsible for the day to day running of your server and mods. 500 Servers will assist in some cases but may not be able to help. We DO NOT garuntee any mod to be working and cannot be held responsible if an application or mod is the direct cause of downtime to your server. Any applications or mods that consistantly cause errors will be removed from our servers.
The above are very basic terms that 98% of people comply with, without having to think about it. You are free to use our services as long and as often as you please - whenever you please, as long as you conform to the Acceptable Use Policy. Users who are found, beyond a doubt, to be in breach of these Terms and Conditions, will have their account status seriously reviewed, leading to either suspension, or termination without a refund.
